1. Introduction.

(a) Website Owner. Eetho Brands Inc. d/b/a Dose (“Dose“) is the owner of this website (“Website”). This online privacy notice discloses Dose information practices for this Website, including what type of personal identifiable information is requested in order to make a purchase, how the information is used, and with whom the in-formation is shared.

(b) Website Visits. In general, you can visit on the Website without disclosing any personal information. Dose keeps track of the domains from which people visit us and analyzes the data gathered from the Website visits for trends and statistics.

(c) Website Transactions. At times, Dose will need personal information regarding a customer or a prospect. For example to process an order or provide a subscription, Dose may need to know a customer’s name, mailing address, e-mail address and credit card details, as further described in Section 2. It is Dose’s intent to inform you before Dose collects personal information, such as the customer’s name and/or address on the Internet. If you tell us that you do not wish to have this information used as a basis for further contact with you, Dose will respect your wishes.

2. Personal Information That May Be Collected.

(a) Identifying Information. In order to make a purchase, Dose will request a user to provide certain personal identifying information, which may include: legal name, postal address, e-mail address, log in identification, password, telephone number, method of payment, and, if applicable, credit card number. Dose may request additional information necessary to establish and maintain customer’s account. Dose, at customer’s sole discretion, may also collect health data information if customer provides such information to Dose.

(b) Payment Information. Dose may collect data necessary to process a customer’s payment if you choose to make purchases, such as your payment instrument number, and the security code associated with your payment instrument. All payment data is handled and stored by ShipStation, Shopify, and PayPal. You may find their privacy notice links in Section 5(c).

(c) Service Quality Monitoring. Some of the Website transactions may require a customer to telephone Dose, or Dose to call the customer. Dose will not contact you by telephone without your prior consent, except to confirm an order placed online and/or to inform a customer of the status of such order. Customer should be aware that it is Dose‘s practice to monitor, and in some cases record, such calls for staff training or quality assurance purposes.

(d) Lost or Stolen Information. If a customer’s credit card and/or password is lost or stolen, the customer should promptly notify Dose in order to enable Dose to cancel the lost or stolen information and to update its records with a changed credit card and/or password.

(e) Chat Requests and Reviews. If you participate in a Dose chat request, or post reviews on the Website, you should be aware that the information disclosed and shared will be broadly available to other persons, both inside of and/or outside Dose, who have access to that chat request (such as Tidio) or reviews. Also, participant’s expressed opinion is his or her own and should not be considered as reflecting the opinion of Dose. You can view Tidio’s privacy policy link in Section 5(c).

(f) Information Automatically Collected. Dose automatically collects certain information when you visit, use, or navigate the Website. This information does not reveal your specific identity (such as your name or contact information) but may include device and usage information, such as your IP address, browser and device characteristics, operating system, language preferences, referring URLs, device name, country, location, information about how and when you used the Website, and other technical information. This information is primarily needed to maintain the security and operation of the Website, and for Dose’s internal analytics and reporting purposes. This information may include, but is not limited to, log and usage data, device data, and location data. (g) Links to Other Websites. The Website may contain links to other websites. Dose is not responsible for the privacy practices or the content of those other websites.

3. Uses Made of the Information.

(a) Limited Uses Identified. Without your prior consent, and subject to Section 4 and 5 herein, Dose will not use your personal identifiable information for any purpose other than that for which it is submitted. Dose uses personal identifiable information to reply to inquiries, handle complaints, provide operational notices and in program record-keeping. Dose also processes billing and business requests related to the Website participation.

(b) Marketing Uses. Unless you opt-out as herein provided, Dose reserves the right to provide you with information about the Website, Dose products and services, and related information in which you have indicated an interest.

(c) Stored Information Uses. Dose stores and retains information. This information is used to compile a customer’s purchase history in order to: enable Dose to recommend products, services, or special offers that would be of interest to a customer; to support customer interaction with the Website; to deliver customer purchases; contact customer again about other Dose services and products; and more.

4. Disclosure of the Information.

(a) Within Corporate Organization. Dose may share your personal information within the Dose corporate organization, and may transfer the information to countries in the world where Dose conducts business. Some countries may provide less legal protection for customer personal information. In such countries Dose will still handle customer personal information in the manner described herein.

(b) Mergers and Acquisitions. Circumstances may arise where for business reasons, Dose decides to sell, buy, merge or otherwise reorganize its businesses in the United States or some other country. Such a transaction may involve the disclosure of personal identifying information to prospective or actual purchasers, and/or receiving such information from sellers. It is Dose’s practice to seek appropriate protection for information in these types of transactions.

(c) Agents. Dose employs or engages other companies and individuals to perform business functions on behalf of Dose. These persons are provided with personal identifying information required to perform their functions, but are prohibited by contract from using the information for other purposes. These persons engage in a variety of functions which include, but are not limited to, fulfilling orders, delivering packages, removing repetitive information from customer lists, analyzing data, providing marketing assistance, processing credit card payments and providing customer services.

(d) Affiliated Businesses. Dose works closely with affiliated businesses operating website stores, providing services or selling products on each other’s Websites. These businesses identify themselves to customers. Customer information related to a transaction with an affiliated business is shared with that affiliated business.

(e) Vendors, Consultants, and Third Parties. Dose may share customer data with third-party vendors, service providers, contractors, or agents (cumulatively “Third Parties”) who perform services for Dose or on Dose’s behalf and require access to such information to do that work. Dose has contracts in place with Third Parties, which are designed to help safeguard customer personal information. Third Parties cannot do anything with customer’s personal information unless Dose has instructed Third Parties to do so. Third Parties will also not share your personal information with any organization apart from Dose. Third Parties also commit to protect the data they hold on Dose’s behalf and to retain it for the period Dose instructs.

(f) Disclosure to Governmental Authorities. Under certain circumstances, personal information may be subject to disclosure pursuant to judicial or other government subpoenas, warrants or orders.

5. Third-Party Analytics and Interest-Based Advertising

(a) Third-Party Partners. Dose partners with Third Parties to engage in analytics, auditing, research, and reporting on the Website. Third Parties may collect information regarding customer’s usage of the Website as described in the section above titled “Information that We Collect” and “Vendors, Consultants, and Third Parties.” In particular, Dose uses Google Analytics and Facebook Analytics on the Website. Dose also partners with Third Parties to provide advertising services that are targeted based on customer’s online activities across websites and devices over time (commonly referred to as “interest-based advertising”). Third Parties may collect information about customer activities on the Website on customer’s current device and combine it with information about customer’s activities on other websites and devices. Third Parties may collect such information using server logs, cookies, web beacons, tags, pixels, cross-device linking, and similar technologies. For example, advertising Third Parties Dose partners with may use the fact that customer visited our Websites to target

advertising to said customer on non-Dose websites on customer’s current device or on other devices customer uses.

(b) Opt Out. You can opt out of interest-based advertising in web browsers by visiting optout.aboutads.info and optout.networkadvertising.org. Please note that the opt-outs will apply only to the specific browser from which you opt out, and therefore you will need to opt out separately on all of your browsers and devices. If you delete or reset your cookies, change browsers (including upgrading certain browsers), or use a different device, you will need to opt out again.

(c) Privacy Policy of Third Parties. We currently use the services of the following third-party vendors, who may collect your information. You can click on the hyperlinks below to view their privacy policies, which may be updated from time to time. Dose will do its reasonable best to update the links when the third-party vendor updates their link.

6. Use of Computer Tracking Technologies.

(a) Use of Cookies. Dose and/or its Third Parties, collects non-identifiable and personal information through the use of various technologies, including “cookies.” A cookie is an alphanumeric identifier that a website can transfer to customer’s hard drive through customer’s browser. The cookie is then stored on customer’s computer as an anonymous tag that identifies the customer’s computer, but not the customer. Cookies may be sent by Dose or its third party vendors. Customer can set its browser to notify customer before a cookie is received, giving an opportunity to decide whether to accept the cookie. Customer may also set their browser to turn off cookies; however, some websites may not then work properly.

(b) Use of Web Beacon Technologies. Dose may also use Web beacon or other technologies to better tailor the Website to provide better customer service. If these technologies are in use, when a visitor accesses these pages of the Website, a non-identifiable notice of that visit is generated which may be processed by Dose or by its suppliers. Web beacons usually work in conjunction with cookies. If customer does not want cookie information to be associated with customer’s visits to these pages, customer can set its browser to turn off cookies; however, Web beacon and other technologies will still detect visits to these pages, but the notices they generate cannot be associated with other non-identifiable cookie information and are disregarded.

(c) Collection of Non-Identifiable Information. Dose may collect non-identifiable information from user visits to the Website in order to provide better customer service. Examples of such collecting include: traffic analysis, such as tracking of the domains from which users visit, or tracking numbers of visitors; measuring visitor activity on the Website; Website and system administration; user analysis; and business decision making. Such information is sometimes known as “clickstream data.” Dose or its contractors may use this data to analyze trends and statistics.

(d) Collection of Personal Information. Dose collects personal identifying information from customer during a transaction. Dose may extract some personally identifying information about that transaction in a non-identifiable format and combine it with other non-identifiable information, such as clickstream data. This information is used and analyzed only at an aggregate level (not at an individual level) to help Dose understand trends and patterns. This information is not reviewed at an individual level.

7. Information Security.

(a) Commitment to Online Security. Dose employs physical, electronic and managerial procedures to safeguard the security and integrity of personal information. Billing and payment data is encrypted whenever transmitted or received online. Personal information is accessible only by staff designated to handle online requests or complaints.

(b) No Liability for Acts of Third Parties. Dose will exercise all reasonable efforts to safeguard the confidentiality of customer personal information. However, transmissions protected by industry standard security technology and implemented by human beings cannot be made absolutely secure. Consequently, Dose shall not be liable for unauthorized disclosure of personal information due to no fault of Dose including, but not limited to, errors in transmission and unauthorized acts of Dose’s staff and/or Third Parties.

8. Privacy Policy Changes and Rights.

(a) Changes to Privacy Policy. Dose may update this Privacy Policy from time to time. The updated version will be indicated by an updated “Revised” date at the top of this Privacy Policy. If Dose makes material changes to this privacy notice, we may notify you either by prominently posting a notice of such changes or by directly sending you a notification. Dose encourages you to review this privacy notice frequently to be informed of how we are protecting your information.

(b) Your Rights. You have rights under data protection laws. However, these rights are not absolute, and Dose may decline your request for such right as permitted by law. These rights include:

· The right to know if Dose is processing your personal data;

· The right to access your personal data;

· The right to correct inaccuracies in your personal data;

· The right to request the deletion of your personal data;

· The right to obtain a copy of the personal data you previously shared with Dose;

· The right to non-discrimination for exercising your rights; and

· The right to opt out of the processing of your personal data if it is used for targeted advertising (or sharing as defined under California’s privacy law), the sale of personal data, or profiling in furtherance of decisions that produce legal or similarly significant effects (“profiling”).

Some states also provide you with the following rights:

· The right to obtain a complete list of the Third Parties to which we have disclosed personal data and the categories thereof (as permitted by applicable law, including California’s, Delaware’s, and Oregon’s privacy law);

· The right to limit use and disclosure of sensitive personal data (as permitted by applicable law, including California’s privacy law); and

· The right to opt out of the collection of sensitive data and personal data collected through the operation of a voice or facial recognition feature (as permitted by applicable law, including Florida’s privacy law).

(c) Exercise of Rights. Additionally, Dose will honor your opt-out preferences if you enact the Global Privacy Control (GPC) opt-out signal on your browser. You may also review your rights under your state’s data protection laws to determine if any other rights are available to you, to which Dose will comply with such laws.

(d) Your California Privacy Rights. Beginning on January 1, 2005, California Civil Code Section 1798.83 permits customers of Dose who are California residents to request certain information regarding Dose’s disclosure of personal information for their direct marketing purposes. To make such a request, please write to: 51 Ne 24th St. Suite 206, Miami, FL 33137. Within 30 days of receiving such a request, Dose will provide a list of the categories of personal information disclosed to third parties for third-party direct marketing purposes during the immediately preceding calendar year, along with the names and addresses of these third parties. This request may be made no more than once per calendar year. Dose reserves its right not to respond to requests submitted other than to the address specified in this paragraph.

California’s privacy laws require a company to provide notice to California users of their rights to receive information on to which entities their information was shared for marketing purposes.

Any dispute over privacy between customer and Dose is subject to the provisions of this notice and to Dose‘s Terms and Conditions which is hereby incorporated herein and which can be read at https://dosedaily.co/pages/terms-and-conditions.
